AND/OR BASKET TICKET ATTACHED THERETO
SHALL HAVE STAMPED THEREON THE WORDS
"GROWN OUTSIDE OF MARYLAND". IT SHALL BE
THE DUTY OF THE PROPRIETOR OR MANAGER OF
ANY SUCH LOOSE LEAF OR HOGSHEAD TOBACCO
MARKET TO RETAIN EVERY BASKET OR OTHER
CONTAINER OF TOBACCO NOT SO MARKED OR
STENCILED OR LABELED UNTIL THE TRUE NAME
OF THE OWNER AND/OR SELLER AND THE OTHER
INFORMATION REQUIRED HEREIN SHALL HAVE
BEEN ASCERTAINED AND PLACED THEREON.
RECORD OF ALL SUCH SALES OF TOBACCO GROWN
OUTSIDE OF MARYLAND SHALL BE KEPT BY THE
SEVERAL SALES AGENCIES.

59P. (Penalty. ) (a) Any person violating any provi-
sion of this sub-title, or any rule or regulation validly pro-
mulgated thereunder, shall be deemed guilty of a misde-
meanor, and upon conviction shall be subject to a fine of
not more than Five Hundred Dollars ($500. 00), or to im-
prisonment for not longer than three months, or to both
such fine and imprisonment, in the discretion of the Court.
In addition to the other penalties provided for herein any
person convicted of selling or attempting to sell tobacco
grown outside the State of Maryland as tobacco grown
inside Maryland shall be subject to a further fine of ten
cents per pound on the total amount of tobacco so sold or
attempted to be sold.

(b) The State's Attorney of each county OR BALTI-
MORE CITY shall enforce the provisions of this sub-title.

Sec. 2. And be it further enacted, That this Act shall

take effect June 1, 1951.

SEC. 2. AND BE IT FURTHER ENACTED, THAT
THIS ACT IS HEREBY DECLARED TO BE AN EMER-
GENCY MEASURE AND NECESSARY FOR THE
IMMEDIATE PRESERVATION OF THE PUBLIC
HEALTH AND SAFETY AND HAVING BEEN
PASSED BY A YEA AND NAY VOTE, SUPPORTED
BY THREE-FIFTHS OF ALL THE MEMBERS
ELECTED TO EACH OF THE TWO HOUSES OF THE
GENERAL ASSEMBLY, THE SAME SHALL TAKE
EFFECT FROM THE DATE OF ITS PASSAGE.
