require an appropriation of approximately $136, 777. 74 for the
fiscal year beginning June 1, 1951, in order to make the supple-
mental payments to retired members of the System.

Since no appropriations were made available in the budget
for this purpose, I have therefore failed to approve this Bill.

Dear Mr. President:


The title of Senate Bill No. 318 provides for the distribution
of the Fire Department Pension Fund of the City of Cumber-
land in the event that the members of the Fire Department
enroll in the State Employees' Retirement System.

While the title would appear to cover a mere possibility or
contingency, the Bill itself, as amended, directs the enrollment
of the members of the Fire Department in the State Em-
ployees' Retirement System.

Since the title of the Bill does not conform to the amend-
ment in the body of the Bill, the Attorney General advises that
in his opinion the title is misleading and invalid under the
provisions of Section 29 of Article III of the Constitution. I
concur in this view and am, therefore, returning the Bill here-
with without my approval.
