AN ACT to add a new section to Article 48 of the Anno-
tated Code of Maryland (1939 Edition) and et. seq.,
title "Inspections, " sub-title "State Horticultural De-
partment, " said new section to be known as Section
63B and to follow immediately after Section 63A, au-
thorizing and empowering the officers of the State Horti-
cultural Department, acting through the State Board of
Agriculture to establish or rescind quarantines against
the introduction from another state of any plant ma-
terial that is known to be infested or infected or that
reasonably may be believed to be infested or infected
with dangerously injurious insects, other animal pests,
or plant diseases; to quarantine areas within the state
and regulate the movement of infested or infected ma-
terial therefrom; to issue regulations under said quaran-
tines with regard to the treatment of soil, implements,
storage facilities or any equipment or materials in the
quarantined area or areas likely to be a factor in the
transmission of the insect, other animal pests or dis-
eases for which the quarantines may be established to
non-quarantined areas; and to. regulate or prohibit the
planting of any crop in the quarantined area, which in
their judgment would prevent or limit the effectiveness
for which the quarantine may be established.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new section be and it is hereby added to Article 48
of the Annotated Code of Maryland (1939 Edition) and et.
seq., title "Inspections", sub-title "State Horticultural De-
partment", said new section to be known as Section 63B
and to follow immediately after Section 63A of said Ar-
ticle and to read as follows:
63E. (a) In order to control, retard or eradicate any
dangerously injurious insects, other animal pests or plant
diseases, the officers of the State Horticultural Depart-
ment, acting through the State Board of Agriculture, may
establish quarantines and/or rescind quarantines against
the introduction into the State of any plant material that
is known to be infested or infected or which reasonably
may be believed to be infested or infected.
