of the mayor, provided, however, that he may be dismissed
by the board of aldermen at any time for cause. He shall
have full and absolute charge of all policemen under the
direction of the board of aldermen. He shall exercise such
powers and perform such duties as shall be required of
him from time to time by ordinance or by rules and regu-
lations adopted by the board of aldermen.

(b) If any member of the police force of the City of
Frederick, who is within the provisions of the Merit Sys-
tem of said police force, shall be appointed Chief of Police,
such person shall, at the conclusion of his term or terms as
Chief of Police, be entitled to reinstatement to his former
position without loss of any of his rights and privileges
under said Merit System, or to such higher grade or posi-
tion to which the mayor and board of aldermen may
appoint him, but subject to all the provisions of the laws
relating to the police force of said City.

INVESTIGATIONS

199. In addition to the Director of Public Safety or
Chief of Police, there shall be two lieutenants, two ser-
geants, and two desk sergeants, all of whom shall be ap-
pointed by the mayor, as occasion may require, subject to
approval of the board of aldermen, all of whom shall be
under the direction and supervision of and receive their
order of duties from the Director of Public Safety or
Chief of Police. All promotions in the personnel of the
police force shall be made by the mayor, subject to ap-
proval of the board of aldermen. All members of the force
shall perform the duties now or hereafter prescribed by
ordinance or rules and regulations passed in pursuance
therewith. The board of aldermen may by ordinance in-
crease or decrease the number of lieutenants, sergeants,
and desk sergeants herein provided for, when in its judg-
ment it shall be proper to do so.

Whenever any investigation authorized by this charter
has been instituted by the police commissioners of the City
of Frederick or by the board of aldermen, both boards
shall have the right upon application to one of the trial
magistrates of the City of Frederick to cause summons
and subpoena duces tecum to be issued for witnesses,
papers, and other documents, to be produced before either
of said boards, at the time designated in the summons.
Both boards shall have the right to administer oaths to
those who appear before them as witnesses and may re-
quire all testimony to be taken under oath. Any person
who shall fail or refuse to obey any such summons shall,
