1434 LAWS OF MARYLAND [CH. 515

CHAPTER 515
(House Bill 678)

AN ACT to repeal and re-enact, with amendments, Section 1036
of the Code of Public Local Laws of Montgomery County
(1947 Edition), being Section 113-69 of the Montgomery
County Code of 1950 and being Article 16 of the Code of
Public Local Laws of Maryland, title "Montgomery County",
sub-title "Rockville", relating to the awarding of contracts
for the purchase of supplies, materials or work by the Town
of Rockville.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That Section 1036 of the Code of Public Local Laws of
Montgomery County (1947 Edition), being Section 113-69 of
the Montgomery County Code of 1950 and being Article 16 of
the Code of Public Local Laws of Maryland, title "Montgomery
County", sub-title "Rockville", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

1036. (113-69). After June 1, [1947] 1951, no contract for
the purchase of any supplies or materials or work involving an
expenditure of [One Thousand Dollars ($1, 000. 00)] Five Hun-
dred Dollars ($500. 00)
or more by the Town of Rockville shall
be let or awarded except to the lowest responsible bidder, after
due and proper advertisement for sealed bids. It shall be appro-
priate to require of each bidder that he accompany his bid with
a certified check in the reasonable amount specified in such
advertisement and that a bond with approved surety may be
required for the faithful performance of any such contract,
checks to be returned to unsuccessful bidder or bidders after
bids have been opened and contract awarded. No contract shall
be let or awarded except on the basis of competitive bidding to
any person who is an official or employee of the Town of Rock-
ville, or to any corporation, partnership, association, or other
business organization in which an official or employee of the
Town of Rockville has a financial interest. Any contract in
violation of the provisions of this Section shall be void, and any
persons responsible for the making of a contract in wilful viola-
tion of the provisions of this Section shall be guilty of a mis-
demeanor and shall be punished by a fine of not more than
Five Hundred Dollars ($500. 00) or imprisoned for not more
than one year, or both.
