to be known as Section 213A and to follow immediately after
Section 213 of said Article, authorizing the Mayor and Coun-
cil of Pocomoke City to establish building lines and to pro-
vide for the construction of curbs and gutters in said Town
and to assess the cost thereof against the abutting property.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
24 of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Worcester County", sub-title "Pocomoke City",
said new section to be known as Section 213A, to follow im-
mediately after Section 213 of said Article, and to read as
follows:
213A. The Mayor and Council of Pocomoke City shall have
full power and authority by ordinance to fix and establish a
building line on any street, lane, alley or thoroughfare in said
Town, or any part or side of any such street, lane, alley or
thoroughfare, BUT SAID MAYOR AND COUNCIL SHALL
NOT HAVE THE POWER TO FIX AND ESTABLISH A
BUILDING LINE ON MARKET STREET BETWEEN 3RD
STREET AND FRONT STREET.
The said Mayor and Council shall also have full power and
authority by ordinance to provide for the construction of curbs
and gutters on any street, lane, alley or thoroughfare in said
Town and to assess one-half of the cost thereof against the
property abutting thereon on a front-foot basis and the re-
maining one-half of the cost thereof to be paid by the Mayor
and Council of Pocomoke City. Any such ordinance or ordi-
nances shall prescribe the time and conditions for the payment
of such assessments. The Mayor and City Council shall give not
less than ten (10) days notice before the passage of any ordi-
nance providing for the construction of any curbs or gutters
on any street, lane, alley or thoroughfare.
All assessments and charges against any property for the con-
struction of curbs and gutters shall be liens against such prop-
erty to the same extent as taxes and shall be collected in the
same manner as taxes.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1951.
