1238 LAWS OF MARYLAND [CH. 438

Laws of Maryland (1930 Edition), title "Anne Arundel
County, " sub-title "Annapolis, " as said Section was enacted by
Chapter 417 of the Acts of the General Assembly of. Maryland,
passed at its January Session in the year 1931, be and the
same is hereby repealed and re-enacted with amendments to
read as follows:

73A. The Mayor [, Counselor] and Aldermen of the City of
Annapolis are hereby authorized and empowered, in their dis-
cretion, to acquire by gift, grant, purchase or condemnation,
any land, with any improvements thereon, either within or
without the limits of said city, for parks, playgrounds or any
other municipal purpose or use, and to enact ordinances regu-
lating the use thereof and said Mayor and Aldermen of the
City of Annapolis are hereby further authorized and em-
powered to sell any such land, or any parcel of land, including
the improvements thereon, no longer needed by the city for any
public use. No such sale of any such property no longer needed
for public use shall be made until the same shall have been first
approved by an ordinance of the city duly enacted and every
such sale shall be made at public sale unless a private sale
thereof be expressly authorized in such ordinance. The con-
veyance of any such property shall be evidenced by a deed
executed on behalf of the city by the Mayor and a majority
of the Aldermen and such deed shall make express reference
to the ordinance approving such sale by number and date of
passage. The power hereby conferred shall apply to all prop-
erty acquired by the city by gift, grant, purchase or condemna-
tion, as aforesaid, as well as all property acquired by and
vested in the city by tax sales or otherwise, and the finding in
the ordinance above mentioned that any such property so sold
is no longer needed for public use shall be conclusive.

SEC. 2. And be it further enacted, That this Act shall take
effect from the date of its passage.
