1837.

SEC. 5. And be it enacted, That if any resistance be
made to the officer directed as aforesaid to execute the
law by any person or persons offending against the same,
it shall be the duty of said officer to summon the posse-
comitatus and proceed therewith, without delay, to
execute his duty under said warrants.

CHAP. 11.

In case of resis-
tance.

SEC. 4. And be it enacted, That if the party so offend-
ing, shall refuse to pay the fine in such case, then the
person or persons so offending, shall be imprisoned in
the county jail for a time not less than thirty days.

Failure to pay.

SEC. 5. And be it enacted, That if the party so offend-
ing be a slave, then and in that case, the person or
persons so offending shall receive any number of lash-
es, not exceeding thirty-nine, that may be ordered by
the justice, before whom the party may have been
convicted.

If a slave.

SEC. 6. And be it enacted, That all fines and forfeit-
ures under this act shall be recovered before any jus-
tice of the peace adjacent to the waters in which the
offence shall have been committed, in the manner small
debts out of court are now recovered.

How recovera-
ble.

SEC. 7. And be it enacted, That all acts or parts of
acts, that are inconsistent with or repugnant to the pro-
visions of this act, be and the same are hereby repealed.

CHAPTER 11.

Repeal.

A further supplement to the act, to Incorporate the
George's Creek Mining Company.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the George's Creek Coal and Iron
Company, be and they are hereby authorised, to lay
out and construct, a Turnpike Road from the lands of
the said company on George's creek in Allegany coun-
ty, to intersect the national turnpike road, at some
point thereof; at Frostburg or between Frostburg and
Cumberland, and that in laying out and constructing
