CHAP. 76.

under said ordinance in the proportions of said last
mentioned assessment, and that the payment of the
same be enforced as said last mentioned assessment
might have been, and be to every effect in lieu thereof.

SEC. 2. And be it enacted, That the Mayor and
City Council of Baltimore be, and is hereby authorised
to pass any ordinance or ordinances for carrying into
effect, the provision aforesaid for payment of the com-
pensation and charges aforesaid and the allowance to
said Lester.

CHAPTER 76.

Passed Jan. 19,
1838.

An act far the benefit of the children of John Murray,
late of Baltimore county, deceased, and to confirm
certain proceedings therein mentioned.

Preamble.

WHEREAS, on the bill of complaint of the heirs at
law of John Murray, late of Baltimore county, deceas-
ed, exhibited in Baltimore county court, sitting as a
court of equity, for a partition of his real estate be-
tween his heirs at law, and to allot to his widow her
dower therein, the commissioners appointed by the said
court for that purpose have returned to the said court
all their proceedings under the commission, and there-
in have assigned to the minors, John Wesley Murray
and Joshua Summerfield Murray, two of the said heirs
at law, for their partition of the said real estate, that
part thereof which had been assigned to the widow for
dower aforesaid; and whereas, doubts are entertained
if the said court have the power to ratify and confirm
the said proceedings, return and partition: and where-
as, the expenses incurred by the said heirs at law in
the premises have been very large, and the remanding
the. commission to the said commissioners for making
an entire new partition would greatly increase said ex-
penses, disproportionate to the interest of the said heirs
in the said estate: and it appears to the General As-
sembly of Maryland that it would be beneficial to the
said minors and the other heirs of the said John Mur-
ray that the said proceedings, partition and return of
the said commissioners should be confirmed: — There-
