CHAP. 73.

surplus, or excess or excesses, to be equally divided
among them at the end of each quarter year, or year,
or at any time when such excess or excesses shall ac-
crue, and it shall be the duty of the cleric of Baltimore
county court, and he is hereby directed and required to
divide any such surplus, excess or excesses, whenever
the same shall accrue, equally among the said judges,

and to pay over the same to them, any thing in any act
of Assembly to the contrary notwithstanding.

Limitation.

SEC. 3. And be it enacted, That this act shall be and
continue in force until the first day of January eighteen
hundred and forty, and until the end of the next session
of the General Assembly thereafter.

A supplement to an act, entitled, an act to appoint Com-
missioners and to authorise them to open and lay out
Alleys in the town of New Windsor, in Carroll
county.

The Alley defi-
ned.
|
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the commissioners named in the law
to which this is a supplement, be, and they are hereby
authorised and required to commence the alley to be
laid on the south side of the town of New Windsor, at
a point in the public road nearly opposite Mr. Atlee's
saw-mill, so as to correspond with the south end of the
lots of said town, running thence the whole length of
the original plat of the town, then by a cross alley of
sufficient dimensions for public convenience to connect
the alley aforesaid with the main street; and the alley
to be laid on the north side of the town to commence at
a point in the public road leading to Union Town, so
as to correspond with the north end of the lots of said
town of New Windsor, and running thence to High
street and no further, unless the commissioners in their
discretion adjudge it necessary, in which case they are
hereby authorised and empowered to continue said alley
so far, and make such cross alley or alleys as the pub-
lic convenience may require.

SEC. 2. And be it enacted, That the commissioners
aforesaid are hereby required to qualify on oath, that
