LAWS OF MARYLAND.

CHAP.355.

year one thousand eight hundred and seven, upon a
bill filed by the State of Maryland, and others, credi-
tors of a certain Gustavus Scott, deceased; and where-
as, the prayer of the said petitioner, that his equitable
interest shall be converted into a legal title, is foun-
ded in justice, and ought to be granted: — Therefore,

Warrant to is-
sue.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Register of the land office of the
Western Shore of Maryland, be. and he is hereby au-
thorised and required, to issue a warrant of resurvey
to the surveyor of Allegany county, directing him to
resurvey and lay out for Benjamin Fowler, that part
or portion of a tract of land, situate in said county,
called Western Connection, which was sold by the
late Roger Perry, to the said Benjamin Fowler, under
the authority of a decree of the court of chancery,
bearing date on the twenty-first day of July, in the
year one thousand eight hundred and seven, which
said part of said tract of land, is designated by the re-
port of the said trustee, Roger Perry, made to the
Chancellor, and plats returned therewith, as the third
division of the second part of Western Connection.

Patent.

SEC. 2. And be it enacted, That upon the return
of the certificate of the said resurvey, and after the
same shall have remained the usual time in the land
office, it shall be the duty of the said register, to issue
a patent upon the same to the said Benjamin Fowler,
if no caveat shall be filed during the period, and in
case a caveat shall be filed, the same shall be heard
and decided in the usual manner by the Chancellor.
and in that case a patent shall issue, or not, according
as the Chancellor may decide upon such caveat, but in
neither case, shall the said Fowler, be required to pay
or shew that the composition money on said land has
been paid.

Compensation.

SEC. 3. And be it enacted, That for the services
hereby required to be performed by the said register.
