1837.

and Ohio Canal to Cumberland and for the completion
of the Baltimore and Susquehanna Rail Road to the
borough of York, in the State of Pennsylvania, passed
at December session, eighteen hundred and thirty-four,
chapter two hundred and forty-one, excepting, in so
far as the said right or priorities are hereby expressly
postponed in favor of the city of Baltimore and this
State, to secure for the payment of the interest on the
loans to be made to the said Company by the said city
and this State, as is herein before provided.

CHAP. 302.

SEC. 5. And be it enacted, That it shall be the duty

of the Baltimore and Susquehanna Rail Road Compa-
ny to provide carriages suitable, and in adequate num-
bers, for the transportation of, and shall promptly
transport all the merchandize and commodities, and
lading of every kind that may be offered for transpor-

tation at such of the depots and stations on the route of
the said rail road as have been assigned or used, or
shall hereafter be assigned for the receiving of property
for transportation upon the main stem of said road,
and the several branches thereof, and it shall be the
duty of the said company to establish at such conveni-
ent and suitable places on said main stem and branch-
es, depots for the reception of property for transporta-
tion, as the Governor shall from time to time direct,
due regard being had to the interest of all parties, and

said company shall .......to damages at the suit of
the party aggrieved, to be recovered by action on the
case, in which this act and the special matter may be
given in evidence.

SEC. 6. And be it enacted, That the same power and
authority are hereby given to the Baltimore and Sus-
quehanna Rail Road Company, to subscribe for and
hold shares in the capital stock of any company that
may be duly authorised by the State of Pennsylvania
to construct any rail road or rail roads between the
Borough of York and some suitable point or points on
the Susquehanna river, as were given to the said com-
pany by the act to which this is a supplement, to ac-
quire and hold stock it; the company incorporated, to
construct the road from the Maryland line to York.
