of any person or persons, without his, her or their
consent.

CHAP. 29.

SEC. 4. And be it enacted, That the aforesaid com-
missioners or a majority of them, shall ascertain the
amount of damages which any person or persons may
sustain, by the laying out and marking said lot of
ground and road, which amount they shall return to
the Levy Court of St. Mary's county, who arc hereby
authorised and directed to levy on the assessable pro-
perty of said county, a sufficient sum to cover all such
damages, and pay the same to the person or persons
entitled thereto.

CHAPTER 29.

Damages.

An act relating to the City of Baltimore.

Passed Jan. 25,
1838.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Mayor and City Council of Bal-
timore shall have power to open and condemn, as a
public Highway, an alley between Charles and Han-
over streets, in said streets, in said city, on the appli-
cation of the persons owning two thirds of the front on
said alley, which alley shall be of the width of twenty
feet, and its centre one hundred and fifty nine feet dis-
tant from the north east intersection of Hanover and
Barre streets, and shall run from Barre street north,
parallel with Hanover street to Conway street.

Authority to
open an Alley.

SEC. 2. And be it enacted, That the mode and man-
ner of opening said alley shall be regulated by an or-
dinance of the Mayor and City Council of Baltimore,
and said alley when opened, as aforesaid, shall in all
respects he subject to the ordinances of the Mayor and
City Council of Baltimore as all public streets in said
city are.
