CHAPTER 28.

1838.

An act to condemn and lay off a lot of ground for a pub-
lic landing at the Yellow Bank, on the St. Mary's river
in St. Mary's county, and make public a road therein
mentioned.

Preamble.

WHEREAS, it. is represented to this General Assem-
bly, by the petition of sundry inhabitants of St. Mary's
county, that they labour under great inconvenience for
want of a public landing on St. Mary's river, and the
making a public road thereto. — Therefore.

Commissioners
to lay out &c.
for a public
landing.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Cornelius Combs, Robert Crane and
William B. Bennett be and they are hereby appointed
commissioners to lay out, survey, mark and hound a
piece of ground of such size and extent as they may
deem expedient, for a public landing at the place called
and known by the name of the Yellow Bank on St. Ma-
ry's county, in such a form as the nature of the ground
and the convenience of the land holders, will permit.

Public Road.

SEC. 2. And be it enacted, That the above commis-
sioners be and they are hereby authorised to condemn
and make public the road leading from a road from St.
Mary's Church to the said yellow bank, the said road
to pass through the farms belonging to Robert Beam
and the heirs of the late Daniel Campbell; provided,
that nothing in this act shall be construed to prevent
the owner or owners, through whose land said road
may pass, from having the priviledge of keeping a free
gate or gates on said road.

Return plat —
Record.

SEC. 3. And be it enacted, That the said commission-
ers or a majority of them, are hereby directed to re-
turn a plat of the said landing and road, when survey-
ed, marked and laid out, and made public as aforesaid,
to the clerk of the County Court, to be by him record-
ed which landing and road shall forever thereafter be

shall be kept up and repaired as other public landings

and roads in said county are; provided, that nothing
herein contained, shall in any manner authorise the
said commissioners to lay out the said landing and
