CHAP. 214.
|
Allegany county, to erect and keep a gate or gates on the
public roads now located and passing through the farm
on which he now resides, for his own private use and con-

venience, upon the express conditions following: the
said John McHenry shall have such gate or gates hung
on good and sufficient iron hinges, and shall keep the
same, and that part of the said road or roads which
they occupy, in good order and repair, so as to impede
as little as possible, persons travelling on said road.
|

Penalty for in-
juring, &c.
|
SEC. 2. And be it enacted, That if any person or
persons, after the passage of this act, shall cut down,
destroy, willfully leave, fixed open, or remove any of
the said gates, they shall, upon conviction thereof, be-
fore a justice of the peace, forfeit and pay to the own-
er of such gate, a sum not less than one, nor exceed-
ing ten dollars, for every such offence, to be recovered
as small debts are out of court.

SEC. 3. And be it enacted, That the levy court or
county commissioners of Allegany county, as the case
may be, shall be and they are hereby authorised to or-
der and direct the supervisor of such road or roads on
which any gate or gates may be erected, as is provided
for in the first section of this bill, to remove, or cause
to be removed, such gate or gates as the public inter-
est may require.

other devisees and legatees of Richard Harwood, of
Thomas, deceased.

Preamble.
|
WHEREAS, it is represented to this General Assem-
bly by the memorial of Edward L. Nicholson and others
devisees and legatees of Richard Harwood of Thomas,
late of the city of Annapolis, deceased, that from sun-
dry causes therein set forth the creditors of the testa-
tor and others cannot be paid, nor the primary objects
of the testator's will accomplished and the interests of
all connected with the estate advanced, without invest-
ing the High Court of Chancery with power to sell
