1837.

court, to be recorded among the records of said coun-
ty; and the said road, when so opened, shall he there-

after deemed to be a public road forever, and shall be
kept in repair in the same manner as other public
roads are directed to be kept in said county.

Public road.

SEC. 2. And be it enacted, That the expenses of sur-
veying and opening said road shall be paid by Worces-
ter county, including two dollars per day to the com-
missioners, while they shall be necessarily engaged in
the surveying and opening said road.

Compensation.

SEC. 3. And be it enacted, That the said commis-
sioners, or a majority of them, shall value and ascer-
tain the damages that may be sustained by any person
or persons through whose land the said road may be
made to pass, taking into consideration the advantages
and disadvantages, if any; and the damages so ascer-
tained shall be levied on the assessable property of
said county, and collected as other county charges are;

and in case any person or persons, through whose
lands the said road shall be made to pass, shall be ag-
grieved by the assessment of damages by the said com-
missioners, an appeal may be taken to the next county
court, who are hereby authorised to take cognizance
of the mutter, and to pass such judgment thereon, as
to them shall seem just and right.

Appeal.

SEC. 4. And be it enacted, That the said commis-
sioners, before they proceed to act, shall take an oath
or affirmation, before some justice of the peace, that
they will, without favor, partially or prejudice, assess
the damages sustained by the persons through whose
lands the said road may pass.

CHAPTER 199.

Oath required.

An act to divorce William B. Sheffield, of the city of
Baltimore, from his wife, Mary Elizabeth Sheffield.

Be it enacted by the General Assembly of Maryland,
That William R. Sheffield, of the city of Baltimore,
be, and he is hereby declared to be, divorced from his
wife, Mary Elizabeth Sheffield, a vinculo matrimonii.
