CHAP. 323.

If witness fail
to appear.

aforesaid, and examine the same on oath, and any person
who shall fail to appear before the said commissioners,
being duly summoned, shall be liable to indictment in the

and imprisonment, at the discretion of the court.

Authority to
appoint clerk—
employ counsel

&c.

SEC. 7. And be it enacted, That the said commission-
ers shall have power to appoint a clerk and fix his com-
pensation; and power, if they deem the interests of the
State require it, to employ counsel to defend the same; and
generally shall have all such power as may be needful to
execute the provisions of this act and ensure justice to
the State, the company and the several persons interested
in the matter submitted to them.

If act be accep-

ted, prosecution
of road to cease.

SEC. 8. And be it enacted, That upon the acceptance
of this act by the stockholders as aforesaid, all further pro-
secution of the said rail road shall cease, and the salaries
of all the officers of the said company shall be disconti-
nued from and after the said period.

Governor to
send copy this
act to State's
agents, &c.

Their instruc-
tions.

SEC. 9. And be it enacted, That the Governor be re-
quested to cause a copy of this act to be sent to each of
the agents or commissioners to vote the stock of the State
in the several internal improvement companies, and the
said agents or commissioners be and they are hereby in-
structed to lay the same before the stockholders of said
company in general meeting for that purpose to be called,
and to advocate and vote for the acceptance of this act;
and when so accepted, this act shall be taken and consi-
dered as modifying the charter of said company, so far as
this act may come in conflict with it.

Return of books
&c. of compa-
ny to W. S
land office.

SEC. 10. And be it enacted, That after the commission-
ers appointed under the provisions of this act shall have
fully discharged all the duties hereby imposed on them,
they shall return to and place under the charge of the re-
gister of the land office for the Western Shore, all the books,
papers, maps and charts, and so forth, of the said Eastern
Shore rail road company.

paid.

SEC. 11. And be it enacted, That nothing herein con-
tained shall authorise the payment of a sum, including
the amount allowed private stockholders, exceeding in
the whole the sum of one hundred thousand dollars.

SEC. 12. And be it enacted, That if there be any thing
in the act of Assembly of eighteen hundred and thirty-
five, chapter three hundred and ninety-five, by which this
State is made liable or may hereafter be made liable to the
Eastern Shore for one million of dollars, to be appropriated
to works of internal improvement, then and in that case
