1839.

award in the premises under their hands and seals, lodged
with the treasurer of the Western Shore, shall be final and
conclusive upon this State, the company and the person
or persons who may have presented any claim or claims

before them, or with whom the said company may have
contracted; provided, that nothing herein contained shall
be construed to authorise the payment or allowance of any
claim or damages growing out of the discontinuance or
abandonment of said road, or on account of the forfeiture
of any contract or engagements of the said Eastern Shore

rail road company.

CHAP; 323.

Award or com-

Proviso.

SEC. 3. And be it enacted, That all such claims as may
be allowed by the said commissioners, shall be paid to the
person entitled to receive the same, ten days after the pro-
duction of the award, by the treasurer of the Western
Shore of this State, in the certificates of debt of this State
at the par value thereof, to be issued for that purpose by

surer, bearing an interest of five per centum per annum,
and redeemable in fifty years from the dates thereof, which
certificates shall be issued in denominations not less than
one hundred nor more than one thousand dollars each; the
interest on which said bonds or certificates shall be pay-
able semi-annually at the loan office, in the city of Balti-

more.

SEC. 4. And be it enacted, That in case of the death,
resignation or refusal to act, or other disability of any of
the commissioners herein appointed, the Governor shall
have power to fill any vacancy; and a majority of the
commissioners for the time being, not less than three, shall
be competent to exercise the powers conferred by this act;
and the Governor shall have power to fix the compensa-
tion of the said commissioners, which shall be paid by
the treasurer, out of any unappropriated money in the trea-
sury.

SEC. 5. And be it enacted, That the commissioners
appointed in pursuance of this act, shall have power to
sell at public sale, or otherwise to convey and transfer on
such terms as they deem proper, or make such disposition
of the property acquired by said company, as they may
deem expedient and most conducive to the interest of the
State, and the said commissioners shall pay the proceeds
of such sale into the treasury of the Western Shore.
