CHAP. 321.

Deed mode va-
lid.

of Washington county, did execute to Henry Lyday, on
the thirteenth March, eighteen hundred and forty, a deed
for a lot of ground in the town of Smithsburg in said
county; and whereas, doubts have arisen as to the validity
of said deed: — Therefore,
Be it enacted by the General Assembly of Maryland,
That the deed executed by Anthony Hoff, an unnatural
citizen of Washington county, on the thirteenth of March,
eighteen hundred and forty, to Henry Lyday, be as
good and valid in law to all intents and purposes as if
said deed had been executed by a naturalized citizen.

CHAPTER 321.

Passed Mar. 20,
1840.

An act to authorise John Lukes and John Lease, to sell a
certain House and Lot therein mentioned.

Preamble.

WHEREAS, it is represented to this General Assembly, by
sundry citizens of Frederick county, that Charles Stephens,
of Frederick county, did, on the thirtieth January, eighteen
hundred and thirteen, by a deed duly recorded in Liber
W. R. No. forty-five, folio four and five, one of the land
records of Frederick county, convey to Christian Cham-
per, William Lease, John Lukes, John Lease, Benjamin
Stevens and Jacob Sheetinhelan, of said county, trustees
of a house and lot, for the purpose of a school house and
and house of public worship; and whereas, from death
and the lapse of time, but two of said trustees, viz: John
Lukes and John Lease are yet surviving, and the said
property has ceased to be used for the purposes for which
it was originally intended: — Therefore,

Authorised to
sell and convey
school house.

And pay over
proceeds.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That John Lukes and John Lease, be, and
they are hereby authorised and empowered, to sell and
convey the said school house and lot with the stone and
appurtenances thereunto belonging, at public sale, to the
highest bidder for cash, as soon as practicable, and to pay
over the proceeds of the same into the hands of the
trustees of primary school district No. sixty-three, to be
applied by them to the purposes of education in said pri-
mary school district.

To convey deed.

SEC. 2. And be it enacted, That the said John Lukes
and John Lease have full power and authority to convey
to the purchaser or purchasers the above named premises
