CHAP. 316.

truly apply so much of the money arising from the sale of
tickets in said scheme or schemes, within six months af-
ter the drawing of said lottery shall commence, as will
satisfy the fortunate adventurers for prizes drawn by them,
and after deducting the necessary expenses incurred in
said lottery, shall within thirty days from the completion
of the drawing of the said lottery, pay the balance of the
money raised by said lottery to the five commissioners,
who are directed by the next succeeding section of this act,
to be appointed by the county commissioners of Frederick
and Montgomery counties.

SEC. 2. Be it enacted, That the commissioners of
Montgomery and Frederick counties, upon being notified
by the commissioners appointed by this act, that the lotte-
ry has been drawn, and the money in their hands, shall
appoint three discreet persons, resident in Montgomery
county, and two resident in Frederick county, who shall re-
ceive the money raised by said lottery, and for the faithful
appropriation of which to the uses herein directed, they
shall give a bond with security to be approved by the com-
missioners of Frederick and Montgomery county, in a
sum equal to the amount raised.

SEC. 3. Be it enacted, That the commissioners direct-
ed by the next preceding section of this act to be appoint-
ed, shall apply the money hereby raised to the construction

to the Monocacy bridge, in Frederick county, on the route
now existing, as nearly as may be practicable.
SEC. 4. Be it enacted, That said commissioners be and
they are hereby empowered to alter the location of said
road whenever in their judgment the public interest may
require it; provided, that the persons owning the land
through which said changes in location would pass, shall
give the land free of charge.

SEC. 5. And be it enacted, That Edward Hughes, Ar-
nold T. Winsor, Samuel T. Stonestreet, Asa Hyatt, Fran-
cis C. Clopper, John Griffith, John McPherson and Cas-
per Quynn, or a majority of them, as may act under this
law, shall lodge in the clerk's office of Montgomery and
Frederick counties, the bond so aforesaid to be given by
them, there to be recorded; and upon such bond or any
office copy thereof, suit or suits may be instituted by the
State or any person or persons interested therein, against
the obligors therein, or any of them, or their legal repre-
sentatives, for any breach or non compliance with the con-
ditions of the same, as public bonds may be sued.
