SEC. 5. And be it enacted, That Thomas J. Stone,
William Biscoe and William J. Blackistone, are hereby
appointed commissioners to examine and inquire into the
rights which the county or Stale may now posses, to a
certain landing on Saint Clement's bay, in Saint Mary's
county, called "Old Wharf, " and the road leading thereto,
and report the same to the commissioners for Saint Mary's

county; and if it shall appear from said report, to the sa-
tisfaction of the commissioners for said county, that the
property aforesaid does already rightfully belong to said
county or state, then said commissioners may, and they
are hereby authorised to take such means as they may
deem necessary to put said county or State in possession
of the same, to be used for the purposes of a public road
and landing.

SEC. 6. And be it enacted, That if the commissioners
aforesaid shall report to the satisfaction of the commis-
sioners for St. Mary's county, that said county or State
does not possess the right to said road and landing, then
and in that event, the said Thomas J. Stone, William Bis-
coe and William J. Blackistone, be and they are hereby
appointed commissioners to condemn and lay off said
landing and road, under the same restrictions and privile-
ges as are conferrred upon the commissioners appointed by
this act to lay off and condemn a road and landing at

Rich Neck; and the commissioners for Saint Mary's coun-
ty are in like manner authorised to assess and pay over to
the person or persons entitled to the same, the amount of
damages allowed by said commissioners.
