CHAPTER 283.

Passed Mar. 17,
1840.

An act to condemn and lay off a Lot of Ground for a
Public Landing, on a certain Tract of Land, called Rich
Neck, in Saint Mary's County, and to make a Public
Road therein mentioned.

Commissioners
appointed to
lay out public
landing.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That William H. Hebb, Thomas Loker and
Cornelius Combs, be and they are hereby appointed com-
missioners to lay out, survey, mark and bound a piece of
ground of such size and extent as they, or a majority of
them, may deem expedient, for a public landing on the
farm called Rich Neck, on the head waters of Saint Mary's
river, in such a form as the nature of the ground and the
convenience of the owner or owners of said farm will
permit.

To make public
road.

SEC. 2. And be it enacted, That the said commission-
ers, or a majority of them, be and they are hereby autho-
rised to condemn and make public a road, leading from
Saint George's road, through said farm called Rich Neck,

Proviso.

to said public landing; provided, that nothing in this act

through whose land said road may pass, from having the
privilege of keeping a free gate or gates on said road.

Return of plat

to be made.

SEC. 3. And be it enacted, That said commissioners, or
a majority of them, are hereby directed to return a plat of
said landing and road, when surveyed, marked, laid out
and made public as aforesaid, to the clerk of the county
county court, to be by him recorded, which landing and
road shall forever hereafter be deemed and taken as a pub-
lic landing and road, and shall be kept up and repaired as

other public landings and roads in said county are; provi-
ded, that nothing herein contained, shall in any manner
authorise the said commissioners to lay out the said land-
ing and road, through the buildings, orchards, gardens or
yard of any person or persons, without his, her or their

consent.

To ascertain
damages.

SEC. 4. And be it enacted, That the aforesaid commis-
sioners, or a majority of them, shall ascertain the amount
of damages which any person or persons may sustain by
the laying out and marking said lot of ground and road,
which amount they shall return to the commissioners of

Levy authorised.

Saint Mary's county, who are hereby authorised and di-
rected to levy upon the assessable property of said coun-
ty, a sum sufficient to cover all such damages, and pay
