CHAP. 215.

Proviso.

cupation of such portion of said alley, be and the same
are hereby vested in the said Franklin rail road company,
and their successors in perpetuity; provided, the said com-
pany shall require the use and occupation of said alley as
part of a depot for the use of said rail road.

Preamble.

An act incorporating the Deer Creek Improving Company.

WHEREAS, it has been represented to this General As-
sembly, that a large section of country bordering on and
adjacent to the extensive valley of Deer creek, in Harford
county, would be greatly benefitted, and the resources of
this State be thereby much increased, by improving the
means of transportation and facilitating trade and travel
in and along the said valley, and by opening and providing
for it a more enlarged and convenient market for produce
and merchandise, by promoting the erection and establish-
ing of workshops, mills, and machinery there, for the man-
ufacturing of grain, wool, iron and other materials, and by

substances applicable to the soil, and by affording induce-
ments to capitalists, artisans and others, to undertake the
working of minerals, of which large deposites of ores
abound in the neighboihood of said valley, and by render-
ing available a vast amount of the best water power in
Maryland, that is now wasted or unemployed — There-
fore,

Incorporated.

Objects defined.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That a company be and is hereby incorporated
for the purposes aforesaid, and the laying out, opening and
making of either a rail road, or a turnpike road, or a canal,
or of a still water navigation of the stream of Deer creek,
and any of its tributaries, or for combining all or any of
the several modes of improvement aforesaid, and with all
or any of their proper appendages and conveniences, in
and along the said valley of Deer creek, or the vicinity
thereof, from some convenient point or points on the Sus-
quehanna Tide Water canal towards the Pennsylvania
line, pursuing the direction of the valley of Deer creek
upwards as far as the said company may deem it practica-
ble or advisable for them to proceed with their said work
or works.
