1839.

also devises and bequests of any person or persons, bodies
corporate or politic, capable of making the same, and the
same at their pleasure, to transfer or dispose of in such
manner as they may think proper; provided always, that
the said corporation or body politic, shall not at any time
hold or possess property, real, personal or mixed, exceed-
ing in actual value the sum of three thousand dollars.
SEC. 3. And be it enacted, That any building that may
hereafter be erected in the town of Cumberland, for the
use of said corporation, and the ground and appurtenan-
ces thereto attached, be and the same is hereby released
from taxation for county purposes.

CHAP. 214.

SEC. 4. And be it enacted, That nothing herein contain-
ed shall be so construed as to authorize or empower
said corporation to issue any notes, certificate, token or
evidence of debt, to be used as a currency; and the right
is hereby expressly reserved to the General Assembly of
Maryland, at its pleasure, to alter, amend or annul this act
of incorporation.

Banking forbid.

Rights reserved.

SEC. 5. And be it enacted, That this act shall continue
and be in force for the period of thirty years and no longer,
from the passage thereof.

CHAPTER 214.

In force.

An act to authorise the closing of part of an Alley in Ha-
gerstown.

Passed Mar. 4,
1840.

WHEREAS, it has been represented to this General As-
sembly, that the Franklin rail road company, which is now
engaged in the construction of a rail road from the Penn-
sylvania State line to Hagerstown, in Washington county,
Maryland, will require as part of a depot for said rail
road, that portion of a twelve feet alley in said town,
which lies midway between west Washington and Frank-
lin streets, commencing at Walnut street and running in a
westwardly direction, the distance of one hundred and
twenty-five feet.

Preamble.

Be it enacted by the General Assembly of Maryland,
that the said Franklin rail road company, be and they are
hereby authorised and empowered to take possession of,
close up and occupy for the use of such depot, that por-
tion of said alley, which is mentioned and described in the
preamble to this act, and that the right, title, use and oc-
