1839.

CHAPTER 201.

An act to authorise the County Court of Allegany County,
to ratify and confirm a sale made by Theophilus Beall,
Constable, to Baptist Mattingly, of certain Real Estate
in the Town of Cumberland.

CHAP. 202.

Passed Feb. 26,
1840.

Be it enacted by the General Assembly of Maryland,
That the judges of Allegany county court, be and they
are hereby authorised and directed, at the next April term
of said court, to ratify and confirm the sale made on the
sixth day of October, eighteen hundred and thirty-eight,
by Theophilus Beall, constable, to Baptist Mattingly, of
certain real estate situate in the town of Cumberland, in
Allegany county, and particularly described in the return
of said Beall, in the case of Nathaniel P. Barnes, versus
James Simmonds, made to Adam Sigler, a justice of the
peace; which said sale, when ratified, to have the same
effect and validity as if all the provisions of the act of

the said court shall be satisfied that said sale, made as
aforesaid, was in all respects bona fide; and provided fur-
ther, that said court shall be satisfied that due notice of
the application for the ratification of said sale was given
to the defendant in said case.

CHAPTER 202.

Provisoes.

An act to authorise the construction of a Bridge and Cause-
way across the Patuxent River, at Queen Anne.

Passed Mar. 4,
1840.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the commissioners hereinafter appointed,
be and they are hereby authorised and empowered to con-
tract for the erection of a good and substantial bridge
across the Patuxent river, at or near Queen Anne, and for
throwing up a causeway across the low grounds of said
river, on the Anne Arundel shore, from the base of said
bridge on said shore, if in the opinion of the said commis-
sioners, or a majority of them, a substantial and permanent
causeway can he constructed, and be necessary to the safe
and convenient passage of said river.
