C H A P. CXXXVI.

1810.

An ACT for the relief of Henry Brown., of the City of Baltimore.

BE IT ENACTED, by the General Assembly of Maryland, That the judges of Baltimore county court,
be and they are hereby authorised and directed, to extend to Henry Brown, of the city of Bal-
timore, the benefit of the act of assembly passed at November session, eighteen hundred and five,
entitled, An act for the relief of sundry insolvent debtors, and the several supplements thereto,
without requiring the said Henry Brown to produce the assent, in writing, of two thirds of his
creditors, as is prescribed by the provisions of the said act and supplements.

CHAP. CXXXVII.

Passed Decem-
ber 25, 1810.

An ACT for the relief of Horatio Clagett, of Charles County.

BE IT ENACTED, by the General Assembly of Maryland, That the judges, or any one of them, of
Charles county court, be and they are hereby authorised and empowered, without the said
Horatio Clagett first obtaining the consent of two thirds in amount of his creditors, to extend and
afford to the said Horatio Clagett all the benefits, advantages and provisions, of the act of assem-
bly passed at November session, eighteen hundred and five, entitled, An act for the relief of sun-
dry insolvent debtors, and the several supplements thereto, in the same manner, and upon the same
terms and conditions, as if he had obtained the assent of two thirds of his creditors to his release
under the same.

CHAP. CXXXVIII.

ber 25, 1810.

An ACT for the benefit of the Heirs of Thomas M'Elderry.

WHEREAS it hath been represented to this general assembly, by the petition of Elizabeth
M'Elderry, John M'Elderry and Thomas M'Elderry, executrix and executors of Thomas
M'Elderry, deceased, that the said late Thomas M'Elderry, a short time before his death, made his
last will and testament, whereby he appointed the said petitioners his executrix and executors; that
in the said will the testator directed his said executors to dispose of so much of his real estate,
commencing with his country place, as would discharge all his just debts, which said last will was
not attested, published and executed, so as to be good and effectual in law as a last will and testa-
ment of real estate; and it is further represented by the said petitioners, that the said late Tho-
mas M'Elderry has a considerable real estate in the city of Baltimore, and the precincts thereof, a
great part of which is now in an unimproved state, and immediately in or contiguous to a very
growing part of the said city; that the said late Thomas M'Elderry, during his life, verbally con-
tracted with several persons for leases for years, upon the usual terms, for certain lots or parcels of
the said real estate, upon the faith of which verbal contracts improvements have been made, and;
that the real estate of the said late Thomas M'Elderry in the city of Baltimore, and the precincts
thereof, which has not been improved upon or leased, must remain for a long time in a waste and
unprofitable situation, unless the said petitioners are enabled to dispose of the same; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Elizabeth M'Elderry, John
M'Elderry and Thomas M'Elderry, or the survivor of them, be and they are hereby authorised and
empowered, as trustees, to sell and dispose of, by public sale, or otherwise, for cash, or on a cre-
dit, as they, or the survivor of them, may think most advantageous, all that tract or parcel of land,.
containing about sixty-five acres, comprising parts of two tracts, the one called Broad's Improve--
ment, and the other called Orange, lying on the old Harford road in Baltimore, about three miles
from the city of Baltimore, and which the said late Thomas M'Elderry purchased of a certain
Benjamin Tracy.

III. AND BE IT ENACTED, That the said trustees, or the survivor of them, on the receipt of the
purchase money, shall, by a good and sufficient deed duly executed and acknowledged agreeably to
law, grant, bargain and sell, make over and convey, to the purchaser or purchasers thereof, and
his, her or their heirs and assigns, for ever, all the right, title, interest and estate, of the said
heirs and representatives of the late Thomas M'Elderry, of, in and to, the lands and premises afore-
said, which said purchaser or purchasers, and his, her or their heirs and assigns, on payment of the
purchase money and interest by them respectively clue, shall have and hold the said lands and pre-
mises respectively, free and clear of all claims and demands of the said heirs and representatives of;
the late Thomas M'Elderry, and each of them, and their heirs, forever; provided nevertheless,
that the said Elizabeth M'Elderry, John M'Elderry and Thomas M'Elderry, before they proceed to
said sale shall give bond, payable to the state of Maryland, with two sureties to be approved of by
the orphans court of Baltimore county, in the penalty of fifty thousand dollars, conditioned for the
