EDWARD LLOYD, ESQUIRE, GOVERNOR. NOVEMBER,

1810.

are hereby authorised, empowered and directed, on the first Monday in January next, or as soon
thereafter as possible, to divide into two equal pares the whole number of convicts condemned, or
shall hereafter be condemned, to work on the public roads in Baltimore county, the one half shall
be employed, under the direction of the levy court of Baltimore county, in opening and repairing
the Liberty-town road, until such time as they may be put in the penitentiary, the other half the
said commissioners shall employ in repairing, straightening and amending, the road lending from
Baltimore to Belle-Air, and the post-road leading from Baltimore to Philadelphia, so as to divide
their time between the two roads in equal proportions, until such time as they may be put in the
penitentiary, any thing in any law to the contrary notwithstanding.

II. AND BE IT ENACTED, That the supervisor of the convicts may, under the direction of the
levy court of Baltimore county, straighten the location of the post-road leading from Baltimore to
Philadelphia in such places as he may think advantageous to the road, provided the same be done
with the consent of the landholders over which the said alteration may be made, and provided also
that no alteration shall be made so as to depart from any public house now kept on the said road.

III. AND BE IT ENACTED, That it shall be lawful for the overseer of the convicts to alter the
location of the road leading from Baltimore to Belle-Air in such place as he shall deem advantage-
ous to the road, between the farm of Thomas Kell and the Little Falls of Gun Powder, provided
the same be done with the consent of the landholders over which the said alteration may be made,
provided also that no such alteration of the location of said road shall be made without the consent
of the levy court of Baltimore county.

LXXXVIII.

An ACT to authorise a Lottery or Lotteries in the City of Balti-
more for the purposes therein mentioned.

WHEREAS by an act of assembly passed at November session, eighteen hundred and five, cer-
tain commissioners were appointed to straighten the road from the north end of Howard-
street until it intersects what was then called the Mill Road, but which is now turnpiked by the
Falls turnpike road company: And whereas sundry inhabitants of Baltimore county have prayed
that a law may pass to authorise a lottery or lotteries to raise a sum of money for the purpose of
paving that part of the road which runs through the alms-house ground; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That it. shall and may be lawful for
Archibald George, Peter Forney, William 1. Alcock, Robert C. Long, Leonard Poudre, Philip
Horn, John Wilson, Jacob Adams, John Lynch, John M'Kinnel, George Peters, John Redy and
William B. Lupton, or a majority of them, to propose a scheme of a lottery or lotteries for raising
a sum of money, not exceeding fifteen thousand dollars, clear of all expenses in drawing said lot-
tery or lotteries, and to dispose of the tickets thereof; provided, the said Archibald George, Peter
Forney, William I. Alcock, Robert C. Long, Leonard Poudre, Philip Horn, John Wilson, Jacob
Adams, John Lynch, John M'Kinnel, George Peters, John Redy and William B. Lupton, or a ma-
jority of them as shall undertake to act under this law, shall, before the sale or disposal of any
ticket or tickets in said lottery or lotteries, give their bond to the state of Maryland in the penalty
of thirty thousand dollars, conditioned that they will well and truly apply so much of the money
arising therefrom, within six months after the drawing of said lottery or lotteries, as will satisfy
the fortunate adventurers for prizes drawn by them, and shall, within twelve months after the
drawing thereof, apply the money raised by such lottery or lotteries to the paving of that part of
the road which runs through the alms-house ground.

III. AND BE IT ENACTED, That it shall be the duty of the said commissioners, before they act
as such, to lodge the bond entered into as aforesaid in the office of the clerk of Baltimore county,
there to be recorded, and upon such bond, or any office copy thereof, suit or suits may be instituted
against the obligors therein, or any of them, or their legal representatives, for any breach or non-
compliance with the conditions of the same.

IV. AND BE IT ENACTED, That the commissioners be and they, or any person or persons ap-
pointed by them, are hereby authorised to dispose of and sell all or any of the tickets of said lot-
tery or lotteries in the city of Baltimore, or any other part of this state, exclusive of any control
of the same by the corporation of the city of Baltimore, any law or usage to the contrary not-
withstanding.
