CHAP. LXXXVI.

Passed Decem-
ber 24, 1810.

An ACT to confirm to Theodore Mitchell, of Anne-Arundel County,
the surname of Swain.

WHEREAS Theodore Mitchell, of Anne-Arundel county, by his petition to this general as-
sembly, hath set forth, that he is the natural son of a certain Mary Mitchell by a certain
John Swain, that he was married by the name of Swain, and prays that a law may pass confirming
to him the name of Swain, and also to confirm and make valid his marriage; and the prayer of the
petitioner appearing reasonable, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the surname of Swain, taken, as-
sumed and used, by Theodore Mitchell, of Anne-Arundel county, and his marriage by the name of
Swain, be and the same are confirmed and made valid, and the name of the said Theodore Mitchell
is hereby changed and altered unto the name of Theodore Swain, and he and his descendants shall
at all times hereafter be called and known by, and held and use the surname of, Swain only, and by
such surname shall sue and be sued in any court of law or equity.

III. AND BE IT ENACTED, That all securities, promises, contracts, assurances, deeds, and law-
ful acts whatsoever, heretofore made or done, or hereafter to be made or done, by as to the said
Theodore Mitchell by the name and surname of Theodore Swain, shall be of the same force, vali-
dity and effect, and equally avail, to all intents and purposes, as if the name and surname of Theo-
dore Swain had been the true and proper name and surname of the said Theodore Mitchell from his
birth, any law or custom to the contrary notwithstanding.

CHAP. LXXXVII.

Passed Decem-
ber 24, 1810.

A Supplement to an Act, entitled, An act to lay out and open a Road
in Caroline County.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Caroline county, that the commissioners appointed by the act to which this is a supplement,
to survey, mark and bound, a public road in Caroline county, beginning at or near James Pearce's,
and running through the lands of said Pearce and other to intersect the road at or near Bullock-
Town, in said county, have surveyed, marked and bounded said road: And whereas the act to
which this is a supplement, prohibits your petitioners from opening said road until first obtaining the
assent of the owner or owners of the land through which the said road is laid down, and there be-
ing minor's land through which the said road is laid, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the road beginning at or near
James Pearce's, and running through the lands of said Pearce, and others, to intersect the road at
or near Bullock-Town, in Caroline county, as surveyed, marked and bounded by the commissioners
appointed by the act to which this a supplement, when made sufficiently passable, and received as
is directed by the original act, shall be deemed and taken as a public road for ever thereafter, and
shall be kept up and repaired as other public roads in said county are,

III. AND BE IT ENACTED, That Nehemiah Townsend, Nathan Whitby and Samuel Colbreath,
be and they are hereby appointed commissioners, and they, or a majority of them, shall ascertain
and value what damages may be sustained by any person or persons whose lands the said road shall
pass through, taking into consideration the advantages and disadvantages, if any, and the same,
when so assessed, shall be paid, or secured to be paid, by the person or persons who have applied to
have the said road laid out and opened as aforesaid to the person or persons entitled to receive the
same.

IV. AND BE IT ENACTED, That the commissioners of review hereby appointed shall have an al-
lowance of two dollars for each day they shall attend in discharge of their duties herein imposed.

V. AND BE IT ENACTED, That so much of the act to which this is a supplement as is contrary
to, or inconsistent with this act, be and the same is hereby repealed.

CHAP. LXXXVIII.

Passed Decem-
ber 24, 1810.

An ACT relating to Criminals in Baltimore County.

BE IT ENACTED, by the General Assembly of Maryland, That Daniel Conn, George Warner and
John Murray, be and they are hereby appointed commissioners, and they, or a majority of them,
