LAWS OF MARYLAND.

CHAP. 46.

time, or within thirty days thereafter, in every year
thereafter shall a new election of trustees as aforesaid
annually take place.

Qualification to

vote.

Sec. 4. And be it enacted, That at the said first
election, and every after annual elections of trustees
under this act, every free male citizen, who is entitled
to vote for Delegates to this Legislature, shall be en-
titled to vote for said trustees; Provided, that he may
have contributed to the building of said academy as
aforesaid.

Case of neglect.

Sec. 5. And be it enacted, That for the purpose of
the said first election of trustees under this act, it shall
be the duty of the five persons first named in the first
section of this act, or any three of them, to give at
least ten days notice in any one or more of the papers
printed in the town of Westminster, of the time and
place of said election, at which election the said five
persons, or any three of them, shall act as the judges
of said election, and it shall be the duty of the trustees
elected at said first election, and all other trustees
elected under this act, to give at least ten days notice
in manner and form aforesaid, of the time and place
of future annual elections or general meetings of the
subscribers to said academy, and the appointment of
judges at future elections shall be provided for by the
by-laws of this corporation, and in case of, the neglect
or refusal of any trustees elected under this act, to give
such notice, a call or notice published as aforesaid by
five of the subscribers shall be sufficient to hold such
election or meeting as aforesaid.

Case of vacancy.

SEC. 6. And be it enacted, That if a vacancy occur
in any board of trustees elected under this act, the
same shall be filled by said board, until the next ensu-

ing annual election.

Power of Trustee.

SEC. 7. And be it enacted. That the trustees that
shall be elected under this act, shall, after the said
academy is erected and fixtures are furnished, have
power to employ and to make such contract with any
teacher or teachers to instruct the pupils that may be
sent to said academy as they may deem prudent.

Charter not forteit-

ed.

Sec. 8. And be it enacted, That nothing contained
herein shall be construed to forfeit this charter, unless
by neglect, an election of trustees shall not take place
within six months after the regular appointed time.
