CHAP. 261.

Direction, &c.

authorized, to extend their road into the State of
Maryland, to intersect the National Road, at or near
the Town of Cumberland, in Allegany county; pro-
vided, that if the said company shall determine to in-
tersect said National Road, near the tavern of James
Pearcy, west of the said Town of Cumberland, they
shall pass through the Town of Cresaptown; provided,
however, that nothing herein contained shall be con-

strued to interfere with any grants heretofore made by

this State to other corporations.

Restrictions and

privileges.

Sec. 2. And be it enacted, That the said North
Branch and Cacapon Turnpike Company, shall be un-
der the same restrictions, and entitled to the same
privileges, that the North Western Turnpike Compa-

ny of Virginia, is entitled to under the provisions of

the act referred to in the above preamble, entitled an
act to incorporate a company to make so much of the
North Western Road, as may pass through Allegany

county.

CHAPTER 261.

1839.

An act to provide for electing the Justices of the Levy
Court of Frederick County, by the people.

Levy Court until

election.

SECTION 1. Be it enacted by the General Assembly

of Maryland, That Martin Eichelberger, Frederick
Troxell, Solomon Forrest, Thomas Springer, Jeremi-
ah G. Morrison, William Lynch, William Dudderar,
Patrick O'Neill, Abel Russell, Daniel Duvall and
Elias Crutchley, the members of the present levy
court of Frederick county, be, and they are hereby
continued in office until the election of justices of the
levy court as hereinafter provided.

districts.

Elect three.

Sec. 2. And be it enacted, That Frederick county
shall be divided into three levy court districts, for the
purpose of electing justices of the levy court for said
county, that the first shall he composed of Hauvers,
Middletown, Petersville and Jefferson districts, which
shall elect three justices of the levy court; the second
shall be composed of Buckeystown, Frederick, New
Market and Liberty districts, which shall elect four
justices of the levy court; and the third shall be com-
