An act, entitled, a further supplement to the act of eigh-
teen hundred and twenty-six, chapter two hundred
and seventeen, and the several supplements thereto,
in relation to the electing Commissioners for Baltimore
County.

Preamble.
|
WHEREAS, by an act passed at December session,
eighteen hundred and twenty-six, chapter two hundred
and seventeen, providing for the election of commis-
sioners for Baltimore county, and transferring the
powers and duties of the commissioners of tax and that
of the levy court of said county; and whereas, the
powers and duties are very important to the people of
said county, inasmuch as they are vested with the en-
tire control of the police of said county, and the levy-
ing and collecting taxes, and disbursing the same to
the amount of more than thirty thousand dollars per
annum; and whereas, by the several supplements here-
tofore passed, their powers have been very much ex-
panded and our expenses increased in a very great de-
gree, we therefore deem it necessary to remodel and
more fully condense the system: — Therefore,

Case of vacancy of
commissioners.
|
SECTION 1. Be it enacted by, the General Assembly of
Maryland, That from and after the passage of this act,
whenever a vacancy may happen in the board of com-
missioners for Baltimore county, by death, resignation.

Election by the
county.
|
or by expiration of service, the vacancy shall be filled
up by a general vote of the whole county, taking care
to confine the choice to be made to the commissioners'
|

From the vacant
district.
|
district where such vacancy may happen, and the per-
son or persons ballotted for, receiving the highest
number of votes taken throughout the county, shall be
considered elected for their respective district or dis-
tricts, and before they proceed to act as such commis-
sioner or commissioners, they shall take and subscribe
|
