CHAP. 177.

vided the said David Koons shall be compelled to file
his petition for the benefit of said insolvent laws, with
a justice of the orphans' court of said county, who is
hereby authorized and directed to make the necessary
orders, and discharge him from actual custody on the
usual terms without proof of residence.

An act to authorize John Kinzer and Surratt D. War-
field, of Frederick County, to sell a certain school
house, known by the name of the Beaver Dam School
House, and the lot and dwelling house attached thereto.

Preamble.

WHEREAS, by an act passed by the General Assem-
bly of Maryland, at December session eighteen hun-
dred and thirty-one, John Kinzer and others, were au-
thorized and empowered to erect a school house and
dwelling house attached thereto, upon a certain lot of
ground which had been conveyed to the said John
Kinzer and others, by a certain John Wampler, by
deed, bearing date the ninth day of April, eighteen
hundred and ten; and whereas, there is no further use
for said school house, or dwelling house attached
thereto: — Therefore,

Authority to sell

school house.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That John Kinzer and Surratt D. War-
field be, and they are hereby authorized and empower-
ed to sell the said school house, known by the name of
the Beaver Dam School House, erected as aforesaid,

in such manner, and upon such terms as they, the said

John Kinzer and Surratt D. Warfield, may think best,

Proceeds applied.

and it shall be the duty of the said John Kinzer and
Surratt D. Warfield to apply the proceeds arising from
the sale of said school house to the building of a pri-
mary school house, at such place within the district in
which the said Beaver Dam School House is now situ-
ated, as a majority of the inhabitants of said district
may direct, and for no other use or purpose whatso-
ever.

Sec. 2. And be it enacted, That the said John Kinzer
and Surratt D. Warfield be, and they are hereby au-
thorized and empowered to sell the said lot and dwel-
