CHAPTER 130.
|
CHAP. 130.
|
|
|
An act for the relief of Thomasina H. Gist, an Orphan.
|
Passed Feb. 25,
1839.
|
|
|
WHEREAS, It has been represented to this General
Assembly of Maryland, by the petition of John L.
Hammond, guardian of Thomasina H. Gist, orphan
daughter of Thomas H. Gist, late of Baltimore county,
deceased, that the said Thomasina H. Gist is seized in
fee simple of several parcels of land, lying in various
parts of Baltimore and Carroll counties, remote and
distant from the dwelling farm of the said Thom-
as H. Gist, which constitutes the more important
and valuable part of the inheritance of the said
Thomasina, which said parcels of land produce a
very small annual income, but if sold at a fair price
would raise a very considerable sum which might be
advantageously invested in the purchase of other lands,
adjoining, or near to the dwelling or principal farm
aforesaid; And whereas, legal difficulties exist, arising
out of the infancy of the said Thomasina H. Gist; And
whereas, also, the effect of such a transaction would be
to change the course of descent of the said property
for all which reasons it seems desirable that there
should be some legislative provision on the subject; —
Therefore,
|
Preamble.
|
|
|
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Baltimore county court shall and may,
upon the petition of the guardian of Thomasina H.
Gist, appoint at their discretion, upon the return of
commissioner to be appointed by the said court, for
the purpose of examining and reporting to the court,
whether a sale of the said parcels of land would be ad-

vantageous to the said Thomasina H. Gist, by a de-
cree, a trustee or trustees, to sell and convey to the
purchaser, or purchasers thereof, any part, or parts
thereof, all the real estate of Thomasina H. Gist, in
Baltimore and Carroll Counties, which is not com-
prised in, adjoining, or contiguous to her principal
estate, being the home or dwelling of her late father,
Thomas H. Gist, and to invest the proceeds of such
sale or sales in other lands adjoining, or contiguous to
the said principal estate.
|
By decree, to con-
vey.
