CHAP. XXXII.

1808.

An ACT annulling the marriage of John C. Hatton and Elizabeth
Hatton, of Somerset county.

Passed 20th of
Dec. 1808.

BE IT ENACTED, by the General Assembly of Maryland, That the marriage of the said John C, Hat-
ton, and Elizabeth his wife, heretofore solemnised, be, and the same is hereby declared to be,
absolutely, and to all intents and purposes, null and void; and the said John C. Hutton, and Eliza-
beth his wife, are hereby declared to be divorced a vinculo matrimonii; provided, that nothing in this
act shall be construed to illegitimate any issue of the said John C. Hatton and Elizabeth Hatton born
prior to the passage of this act.

CHAP. XXXIII.

Marriage de-
clared void.

An ACT granting leave to the trustees of the Lower West Notting-
ham congregation, in Caecil county, and their successors, to receive
a deed or deeds for and hold the lands therein mentioned.

Dec. 1808.

WHEREAS the trustees of Lower West Nottingham presbyterian congregation, by their peti-
tion to this general assembly have represented, that many years since a division took place
in said congregation, and in consequence thereof two houses of worship were erected, with a grave-
yard attached to each, which hath been used for those purposes for many years; that a re-union of
said congregation hath since taken place, and that they have, at considerable expense, erected a
meeting-house and session-house, and have also enclosed a burial-ground on a lot of land more cen-
tral to said congregation; that they have been lately incorporated according to law, and the trustees
have prayed this general assembly for leave that themselves and their successors may hold, in trust,
for ever, for the sole and exclusive use of said congregation, the above three lots of land, on each of
which there is a burial ground, and containing in the whole five acres and twenty-three perches and
an half perch of land; therefore,

Preamble.

II. BE IT ENACTED, by the Genet al Assembly of Maryland, That the leave of the legislature is here-
by given to James Cummings, James Evans, David Edmiston, Elihu Hall, Robert Evans, and others,
holding lands, intrust, for the use of Lower West Nottingham presbyterian congregation, to con-
vey to the trustees of said congregation, and their successors, in fee, by deed or deeds of bargain
and sale to be executed, acknowledged and recorded, according to law, all and singular the above
three lots of land, containing five acres twenty-three perches and five tenths of a perch of land, on
one of which lots is erected a house of worship and session-house, and includes a new burial-ground,
the other two lots being used as burial-grounds only by said congregation, and the said trustees, and
their successors, are hereby authorised and empowered to hold the same for the purposes aforesaid
for ever here after.

CHAP. XXXIV.

An ACT authorising James Cochran to complete his collection,

WHEREAS Janus Cochran, collector of the first collection district of Caecil county, has by his
petition to this general assembly set forth, that he has been unable to complete his collection,
owing to the low price of grain, and little demand for it, and the great scarcity of circulating cash
among the people, and other unavoidable causes, and pray that longer time may be allowed hun to
complete the same; therefore,

Dec. 1808.

Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That the said James Cochran be authorised
to collect all balances due him as collector, at any time before the first day of June, eighteen hun-
dred and nine, in the same manner as he could or might have done within the time limitted by law,
any law to the contrary notwithstanding.

III. PROVIDED ALWAYS, AND BE IT ENACTED, That the said James Cochran, before he proceeds
to execute or distrain the property of any person or persons for taxes, shall, at least thirty days
before such execution or distress, deliver to the person or persons chargeable with the same, an ac-
count, written in words at full length, of the taxes demanded of him, her or them, with an affidavit
annexed to the same, that no part thereof, nor any thing insecurity or satisfaction for the same,
hath been received, more than credit given.
