Judges to grant
license, &c.

CHAP. XXXV.

An ACT for the benefit of Daniel Burch, of Worcester county.

BE IT ENACTED, by the General Assembly of Maryland, That the judges of Worcester county court,
in court sitting, or any one of them out of court, be and are hereby empowered and authorised,
from time to time, to grant license to Daniel Burch to keep an ordinary on the North Beach, conti-
guous to Sinepuxent Inlet, in said county, for which license the said Daniel Bun h is hereby relieved
from the payment of the sum of money required by law; provided always, that the said Daniel
Burch shall first enter into the recognizance prescribed by law to be entered into by ordinary-
keepers.

CHAP. XXXVI.

A Supplement to an act, entitled, An act to lay out and straighten a
road in Baltimore county.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Baltimore county, that an act passed at November session, one thousand eight hundred and
four, authorising commissioners to lay out and straighten a road therein mentioned, and that the
commissioners, notwithstanding their utmost industry, have not been able to open the said road for
the want of money to pay the damages sustained by persons through whose farms the said road passes;
therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the levy court of Baltimore county
be and they are hereby authorised, at their discretion, to appoint commissioners to lay out, straighten
and amend, the road beginning at the Frederick county line, at or near Ludwick Wampler's mill,
from thence to Henry Ebaugh's mill, then to intersect the Hanover turnpike road, at or near cap-
tain Richard Richard's school-house, of a width not exceeding thirty feet, in the straightest and best
direction that the nature of the ground will admit of; and the road, when so laid out, straightened
and amended, and the valuation herein after directed to be made shall have taken place, shall be re-
corded by the clerk of Baltimore county court, and for ever thereafter be deemed a public highway,
and kept in repair as other public roads in said county; provided, that the said road shall not be
opened through the buildings, yards, gardens or orchards, of any person, without his or her consent.

III. AND BE IT ENACTED, That the said commissioners, or a majority of them, under the direc-
tion of the levy court, should they think it just and equitable, shall ascertain and value what da-
mages may be sustained by any person or persons through whose land the said road may pass, taking
into consideration the advantages and disadvantages, if any, and the same when so assessed, shall
be paid to the person or persons entitled to receive the same, by a levy upon the county, made at the
discretion of the levy court, provided the sum levied does not exceed five hundred dollars.

CHAP. XXXVII.

An ACT for the benefit of the corporation of the Roman catholic
clergymen.

Preamble.

WHEREAS Germain Barnaby Betouzey, by his petition to this general assembly, hath set forth,
that the corporation of the Roman catholic clergymen are possessed of a tract of land called
Carrollsburg, and part of another tract called Cheney's Adventure, lying and being; in Prince-George's
county, and that a vacancy was discovered and taken up between the same by a certain Colmore
Duvall, which vacancy was afterwards purchased by the said Germain Barnaby Betouzey, and pray-
ing that he may be authorised to transfer his title to the same to the said Roman catholic clergymen;
and the prayer of the petitioner appearing reasonable, therefore,

If. BE IT ENACTED, by the General Assembly of Alary land, That the said Germain Barnaby Betouzey,
be and he is hereby authorised to convey and transfer unto the said corporation of the Roman catho-
lic clergymen, all his right, title and interest, in and to the aforesaid vacancy, to be held, occupied
and enjoyed, by the said corporation, and their successors, in the same manner, and for the same
uses and purposes, that other lands are held or occupied and enjoyed by them, under an act of assem-
bly, entitled, An act for securing certain estates and property for the support and uses of ministers,
of the Roman catholic religion.
