rated or fixed by the levy court to be allowed to labourers or hands hired to work on the road, for
each and every day any person shall be warned or summoned to work as aforesaid.

CHAP.
LVIII.

II. AND BE IT ENACTED, That when any person warned or summoned to attend and work on
the roads as aforesaid, shall neglect so to attend by eight o'clock in the morning, or refuse to pay as
before directed, shall forfeit and be fined seventy-five cents, to be laid out on the roads, and may be
recovered before a justice of the peace, unless by him excused on account of sickness or some such
sufficient excuse.

III. AND BE IT ENACTED, That any person appointed by the levy court as supervisor, shall be
bound to serve as such for one year, under the penalty of twenty dollars in case of refusal, to be
recovered before a justice of the peace and expended on the roads.

IV, AND BE IT ENACTED, That the levy court of Allegany county be and they are hereby au-
thorised to levy on the assessable property in said county, such sum or sums of money as in their
judgment and opinion may be deemed necessary and sufficient to complete the bridge now building
over Will's creek, in the town of Cumberland.

V. AND BE IT ENACTED, That any provisions contained in any former law or laws on this sub-
ject, inconsistent with the present, shall be and the same are hereby made void.
CHAP. LIX.

Provisions

An ACT to lay out, straighten and confirm, a certain road in Har-
ford county.
|

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Harford county, that the convenience of the public will be greatly promoted by straighten-
ing and amending the road now used, leading from Josias Carvill Hall's land, by Charles Rigden's
mill, until it intersects the road leading to Smith's ferry at or near a place known by the name of
The Quaker Bottom; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That Roger Boyce, Paca Smith and Tho-
mas Mitchell, be and they are hereby appointed commissioners, and they, or a majority of them,
are hereby authorised and empowered to view, lay out, straighten and confirm, a certain road now
leading from Josias Carvill Hall's land, in Harford county, until it intersects the road leading to
Smith's ferry on the Susquehanna, not exceeding twenty-six feet in width, beginning at the north
end of the first lane on the road leading from Crispin Cunningham's to the lower cross roads in
Harford county, thence to Charles Rigden's mill, thence between the lands of Benjamin Fletcher
and Charles Rigdon, and thence with the old road, straightening and amending the same until it in-
tersects the road leading to Smith's ferry at or near a place called and known by the name of The
Quaker Bottom, on the best ground, and with the least possible injury to the person or persons
through whose land the same may pass; provided, that the said road shall not go through the yards,
gardens or orchards, of any person or persons, without his, her or their consent,

III. AND BE IT ENACTED, That the said commissioners, or a majority of them, are hereby re-
quired to return a plot of said road to the clerk's office of said county, there to be recorded, together
with an estimate of the damages, if any, sustained by any person or persons through whose land the
same may pass, and the levy court of said county shall, at their first meeting after the return of the
said plot and estimate of damages, by warrant under their hands and seals, appoint an overseer to
open and clear said road, agreeably to said plot, in the same manner as other roads are opened and
cleared, and the overseer shall have the same allowance for his services as other overseers in said
county.

IV. AND BE IT ENACTED, That the levy court of Harford county are hereby empowered and
directed to assess and levy such sum of money as they in their judgment shall deem necessary to
open and clear such road, which said sum of money shall be collected and paid over as other county
charges.

this act, shall be amended and kept in repair in the same manner as other public roads in said coun-
