county, over which the line of the Eastern Shore Rail
Road was constructed. And whereas, alter the death
of the said Philip Smith, the commissioners appointed
to settle up the affairs of the Eastern Shore Rail Road
Company, did view the said land, and for the damage and
injury done to the same did make two several awards as
follows to wit, to Ann Smith and others, adult heirs of
Philip J. Smith, for one hundred and fifty-two dollars, and
to "the four minor heirs of Philip J. Smith for seven hun-
dred and four dollars, " as appears by their return made to
the treasurers office for the Western Shore, in which said
awards the name of Philip J. Smith is erroneously used for
that of Philip Smith. And whereas James M. Smith was
by the last will and testament of the said Philip Smith ap-
pointed one of his executors, and has from the Orphans
Court of Cecil county, obtained sole letters testamentary
on the estate of the said Philip Smith. And whereas the
the commissioners appointed to settle up the affairs of the
Eastern Shore Rail Road Company, did on each of their
awards issue certificates of the amounts of such ward
without the production of which the commissioner of loans
for the State of Maryland, has declined to issue certificates
of State stock. And whereas the certificates of the awards
of damage done to the lands of the said Philip Smith as
aforesaid, have never come to the hands of the said James
M. Smith his executor as aforesaid, but they have been mis-
laid, lost or destroyed and he is unable to procure the same.

Section 1. Be it enacted by the General Assembly of
Maryland, That the commissioner of loans for the State of
Maryland, is hereby authorised, empowered and directed
to issue to James M. Smith, the executor of the last will
and testament of Philip Smith, late of the city of Philadel-
phia, or to his attorney authorised by him to receive the
same, certificates of the State stock to the amount of eight
hundred and fifty-six dollars, bearing an interest of five per
cent per annum, in compensation and liquidation of the in-
jury and damages done to the lands of the said Philip
Smith deceased, and which said amount was awarded as
damages by the commissioners appointed to settle up the
affairs of the Eastern Shore Rail Road Company as follows
to wit: to "Ann Smith and others, adult heirs of Philip J.
Smith, for one hundred and fifty-two dollars, " to "the four
minor heirs of Philip J. Smith, for seven hundred and
four dollars, " without the said James M. Smith or his
attorney producing to the commissioner of loans, the certi-
ficates of the amounts awarded, for the damages by the
commissioners appointed to settle up the affairs of the Eas-
tern Shore Rail Road Company which have been mislaid,
lost or destroyed.
