and the clerk of the county court, shall make out a copy
of any judgment rendered by the said Magistrates Courts,
for sums not exceeding fifty dollars, upon which copy any
justice of the peace in the county, may issue execution;
and the said clerk may issue executions upon judgments
rendered by the said Magistrates Courts, for sums exceed-
ing fifty dollars; and all undecided cases pending before the
Magistrates Courts, for sums exceeding fifty dollars, shall
be transferred to the docket of the county court, and the
said court shall proceed with the case, as if the suit had
been originally instituted in the county court, and all out-
standing writs issued by the said Magistrates Courts, shall
be returned by the officer having the same, to the county
court or a justice of the peace, according as the court or
justice may have jurisdiction of the case, and the same
when returned, shall be proceeded on in all respects as if
the writ had been issued from the court, or by the justice
to whom it may be returned.

Sec. 2. And be it enacted, That the judges of Queen
Ann's county court, shall have, hold and exercise concur-
rent jurisdiction with the Magistrates Courts, in all cases
where the debt or damages laid or claimed, shall exceed
fifty dollars.

An act to authorise the clerk of Queen Ann's County
Court, to correct a sheriff's return therein mentioned.
|
|
Preamble.
|
Whereas it has been represented to this general assembly
by the petition of John McKenney, accompanied by testi-
mony to prove the truth of the allegations, that Thomas
Roberts, former sheriff of Queen Ann's county, under a
writ of venditioni exponas, sold certain lands of one Arnold
Jacobs, to the said John McKenney, and that the said sheriff
by mistake, put the return in another venditioni exponas,
then in his hands, instead of filing it with the writ under
which the return states the sale to have been made, and it
clearly appears that a mistake was made by the said sheriff".

Section 1. Be it enacted by the General Assembly of
Maryland, That the clerk of Queen Ann's county court, be
and he is hereby empowered and directed, to withdraw the
special return made by Thomas Roberts, former sheriff of
the said county, filed in a certain case on the judicial docket
