personal which may remain after the death of the wife of
said testator, and that the wife of said Chas. Yager has de-
parted this life, and no claim for said property, real and per-
sonal has ever been made by the said Christiana and Ann
Maria Yager, or their heirs, nor is it known whether said le-
gatees are living or dead, or where they reside, and the said
Jacob Keller, being desirous of renouncing the trust repo-
sed by said will, and the said Lutheran church being wil-
ling to accept thereof and to account for said property in
case any claim shall hereafter be made by said legatees or
their heirs, and not being empowered by their constitu-

tion to act as trustees—Therefore,
Section. 1. Be it enacted by the General Assembly of
Maryland, That "The Evangelical Lutheran Church of
Frederick, " by and under the name of the Evangelical Lu-
theran Church of Frederick, be and they are hereby autho-
rized and empowered to act as trustees of the will of Charles
Yager deceased, and to hold the property devised to Ja-
cob Keller in trust as aforesaid, as soon as the said Jacob
Keller shall be discharged of his trust, by a decree of
Frederick county court, as a court of equity, upon the
application of the said Jacob Keller, or of the said Evan-

Sec. 2. And be it enacted, That the said Evangelical
Lutheran Church of Frederick, be, and they are hereby
authorized, to execute such bond as may be required by
Frederick county court as a court of equity, for the faith-
ful discharge of the trust reposed in them, which bond
shall be signed and sealed by the president of council
for the time being, and whose seal, should the said cor-
poration have no common seal, be considered adopted
