CHAPTER 216.

CHAP. 216

An act to authorize Lucretia D. Hopper and Philemon B.
Hopper, Jr. to mortgage certain real estate therein men-
tioned.

Passed Feb'y.
27, 1844.

Whereas Thomas W. Hopper, late of Queen Ann's
county, died seized of certain lands in said county sub-
ject to the payment of his debts, leaving a widow and one
child, named Thomas W. Hopper, a minor; and where-
as, for the purpose of saving the land to the said child,
and to prevent it being sacrificed at a forced sale, a sum
of money can be borrowed to pay said debts, if the land
can be charged with the re-payment—Therefoie,

Preamble

Be it enacted by the General Assembly of Maryland,
That Lucretia D. Hopper and Philemon B. Hopper, jr.
and in case of the death of either of them, the survivor
shall have lull power and authority to mortgage the said
lands to secure the payment of any sum or sums of mo-
ney which may be advanced to pay the debts aforesaid,
and shall convey the right of the said Thomas W. Hop-
per, infant son of Thomas W. Hopper, deceased, in the
lands aforesaid, and said deed of mortgage shall have the
same effect in law, as if it had been executed by the said

Survivor may
mortgage, &c.

Thomas W. Hopper, infant as aforesaid at full age; pro-
vided, the said Lucretia D. Hopper, and Philemon B.
Hopper, jr. or either of them, and the Orphan's court of
Queen Ann's county, shall be of the opinion that such
mortgage would be for the interest of said minor.

Proviso.

CHAPTER 216.

 

An act to authorize John Newcomer, former Sheriff of
Washington county, to execute a certain deed.

Passed Feb'y.
27, 1844.

Whereas, it appears that John Newcomer, former
Sheriff of Washington county, whilst he was sheriff, by
virtue of a writ of fieri facias, to him directed, at the suit
of the Hagerstown Bank, against a certain Abraham
Barnes, said writ being marked number one hundred and
twenty-five, Judicials, to November term of said coun-
ty court, eighteen hundred and thirty-seven, did sell
all the right, title and interest of the said Abraham
Barnes, in and to a certain house and part of a lot in Ha-
gerstown, to a certain Richard W. Davis, and returned
