of said roads so placed under their charge, in good condi-
tion for the use and passage of all carriages of pleasure or
burthen, and that it any section of said roads shall be suf-
fered to reman in an impassable, inconvenient or dangerous
condition for the space of fifteen successive days, it shall
be and hereby is made the duty of any justice of the peace
of said county, on complaint made to him, by any person or
on his own view thereof, to summon the contractor having
charge of said section, before him, and examine into the
circumstances of such default, and impose such fine on him
not exceeding fifty dollars, as he. shall think right.

CHAP. 205

SEC. 5. And be it enacted, That if the levy court shall
be unable to let out within a reasonable time, after notice
given, any portion of said roads, in the manner herein
before provided, and upon such terms as they may deem
advantageous to the county, then they shall provide for the
repair thereof in the manner now used and practiced.

Sec. 6. And be it enacted, That all laws inconsistent
with the provisions of this act, are hereby repealed.

An act to authorise Christian Keener and Isaac Tyson jr.,
to close up Asbury street.

Passed March
1, 1844.

Section 1. Be it enacted by the General Assembly of
Maryland, That Christian Keener, Isaac Tyson and others,
property holders and petitioners therefor, are hereby autho-
rised and empowered to close up a narrow street, called
Asbury street, extending from Baltimore street to Pratt
street, and between Republican and Calhoun streets, in the
city of Baltimore, and they are hereby vested with full
right, title and interest", in and to the bed of the said Asbury
street, in just and equal proportions to their respective act-

two of the public prints, once a week, and no objection
being made thereto.

Proviso.

Sec. 2. And be it enacted further, That this law shall

and who on the usual application of the said petitioners, and
the usual notice through the public prints, the said mayor
and city council, may proceed to close up said Asbury
street, in the same way as made and provided for, by an
