CHAP. 174.

In force one
year.

he hath not received any part thereof other than the credits
given.
Sec. 3. And be it enacted, That this act shall be and
continue in force one year and no longer.

A further supplement to the act to regulate sales by
public auction, passed at December session eighteen hun-
dred and twenty-seven, chapter one hundred and eleven.

Preamble.

Whereas, many merchants and others of Allegany
county, by their petition to the General Assembly of Mary-
land, have represented that persons are from time to time,
gelling goods at auction in Cumberland, without license by
which means they come in competition with other merchants
who are compelled to pay heavy sums for said right to
vend &c. And whereas, the said merchants and others
are advised that there is no law by which auctioneers in
said county are required and compelled to pay for license
to vend goods &c. at auction. Therefore,

vilege.

Section 1. Be it enacted by the General Assembly of
Maryland, That from and after passage of this act, it snail
not be lawful for any person or persons to vend at auction
any goods, wares or merchandise of any name, kind or
description whatever, within the limits of said town of
Cumberland, or within the circuit of one mile thereof, or
within the limits of any other incorporated town in said
county, unless said person or persons, shall previously to
such vending at auction, pay to the clerk of said county the
sum of one hundred dollars for such privilege for one year,
or eight dollars per day for each day they may be employed
in selling as aforesaid, to be applied to the use of the State,
and to be paid into the treasury thereof by said clerk, who
shall be entitled to receive the same fees for like services
performed by said clerk under existing laws.

To apply to
persons from
abroad.

Sec. 2. And be it enacted, That the provisions of this
act shall extend and apply only to such person or persons
as shall bring goods, wares, merchandise &c, from abroad
to sell at auction within the limits aforementioned, and to
such person or persons as shall sell at auction goods, wares
or merchandises sent from abroad for the express purpose
of selling upon commission.

Sec. 3. And be it enacted, That any person or persons
who shall sell as aforesaid, within the limits aforesaid, with-
