CHAPTER 98.

CHAP. 99.

A further supplement to the act entitled, An act to abolish
Magistrate's Courts in Allegany County, and extend the
jurisdiction of single Justices of the Peace in said coun-
ty, passed at December session, eighteen hundred and
thirty-nine, chapter seventy-seven.

WHEREAS, no provision is made in the act to which this
is a further supplement, to authorize the closing of judg-
ments rendered by the Justices of the Magistrate's Courts'
in Allegany county, and which have been recorded in the
clerk's office of said county as required by the tenth sec-
lion of the original act — therefore,

Preamble.

Be it enacted by the General Assembly of Maryland,
That it shall be the duty of the clerk of said county upon
the application of the plaintiff or plaintiffs, his, her or their
agent or attorney, to issue fieri facias, scieri facias or any
other writ or process for the closing of any such judgment
recorded as aforesaid, which said process shall be directed
to the Sheriff of said county and made returnable to the
next succeeding term of Allegany county court after the
issuing of the same, in the same manner as if the said judg-
ment had been obtained in the said court.

SEC. 2. And be it enacted, That the judges of Allega-
ny county court be, and they are hereby authorized and re-
quired, to take cognizance of all process issued as directed
by the first section of this act.

SEC. 3. And be it enacted, That the clerk of Allegany
county court shall receive the same fees for the services
imposed upon him by this act as is now allowed by law for
similar services.

CHAPTER 99.

 

An act to make valid a certain deed of Mortgage therein
mentioned.

Passed Jan.
16, 1843.

Be it enacted by the General Assembly of Maryland,
That the deed of Mortgage heretofore executed by a cer-
tain James L. Bowers, to Elizabeth Bowers, of Kent county,
and bearing date on or about the twenty-third day of Fe-
bruary, in the year eighteen hundred and forty-one, and du-
ly recorded amongst the land records of Kent county, on the
nineteenth day of April, eighteen hundred and forty-one,
