FRANCIS THOMAS, ESQUIRE, GOVERNOR.

CHAP. 97.

May grade
road 30 feet.

SEC. 7. And be it enacted, That the said company bef
and they are hereby authorized and empowered to grade
said road to the width of thirty feet, and may, if said com-
pany shall deem it necessary, for the public advantage,
stone the said road to the width of twenty feet.

Fine for drag-
ing timber on
said road.

SEC. 8. And be it enacted, That no person or persons
shall be permitted to drag sawed logs or other timber upon
said road, under the penalty of five dollars for every vio-
lation of this section of the law; the same to be recovered
before any justice of the peace in this State as other small
debts out of court are now collected.

President and
Directors to be
citizens.

SEC. 9. And be it enacted, That the president and at
least two of the directors of said company, must at the
time of their election, and during the time for which they
are elected, be citizens of the State of Maryland.

Supervisor of
old road to dis-
pose of tim-
bers, &c.

SEC. 10. Be it enacted, That the supervisor of the
old county road is hereby authorized and empowered to
dispose of the timbers and plank of which the bridges on
said road are constructed, for the use and purposes of the
county.

Persons in
certain cases
exempt from
toll.

SEC. 11. And be it enacted. That all persons carrying
grist to and from mill on horse-back, and going to and from
church, and jurors and witnesses summoned to Allegany
county court, going to and returning from said court, shall
be exempted from the payment of toll on said road.

 

CHAPTER 97.

8, 1843.

An act to confirm and make valid a Deed therein mentioned.

Deed made
valid.

Be it enacted by the General Assembly of Maryland,
That the deed of conveyance executed by James McMul-
len and Rachel his wife to Meshack Browning, dated the
eighth day of December, eighteen hundred and thirty-two,
for two hundred and fifty-eight acres of land, and duly re-
corded among the land records of Allegany county within
the time then required by law for the recording of deeds,
is hereby declared to be as valid and operative to all inter»
ests and purposes as if the same had been duly acknowledg-
ed by the said James McMullen one of the grantees therein
mentioned.
