tread four-wheeled wagon drawn by four horses, twenty-five
cents; for every narrow tread four-wheeled wagon drawn
by six horses, thirty-seven and one half cents; for every
broad tread four-wheeled wagon drawn by four horses,
twenty cents; for every broad tread four-wheeled wagon
drawn by six horses^ thirty cents; for every narrow tread
four-wheeled wagon drawn by two horses, fifteen cents; for
every narrow tread four-wheeled wagon drawn by three
horses, twenty cents; for every narrow tread four-wheel
wagon drawn by one horse ten cents; for every sled or
sleigh drawn by one horse, six cents; for every sled or
sleigh drawn by two horses, twelve and one half cents; for
every score of cattle, twenty cents; for score of sheep or
hogs, ten cents.

CHAP. 96.

SEC. 2. And, be it enacted. That if any person or persons
whomsoever subject to the payment of tolls pursuant to this
or the original act, shall pass through any private gate or
bar, or along or over any private passage-way or any ground
near to, or adjoining any turnpike gate, or over any other
ground, with an intent to evade the payment of the toll or
duty for passing through any such gate or turnpike, or prac-
tice any other fraudulent means or device, or misrepresent
the distance used or travelled with the intent that every
such tolls may be evaded or lessened, all and every such
person or persons, in all, every or any of the ways and
manners aforesaid offending, shall for every such offence,
forfeit and pay to the said company, the sum of five dollars,
to be sued for and recovered with costs of suit, before any
Justice of the Peace, in like manner as debts of a similar
amount may he sued for and recovered.

SEC. 3. And be it enacted, That all the provisions of
the sixth section of the original act, be, and the same are
hereby extended, so as to authorize and empower said com-
pany to acquire title to all lands needed for the erection of
toll-houses and so forth.

SEC. 4. And be if enacted, That it shall be the duty of
the Sheriff of Allegany county to deliver to the clerk of
said county all inquisitions which shall be taken in virtue of
this act, and the said clerk is hereby required to record the
same among the land records of said county.

SEC. 5. And be it enacted, That the said company are
hereby required to cause to be closed up, all that part of the
old county road leading from the town of Cumberland to
the Pennsylvania line, commonly called the Will's creek
and Jenning's run road, or so much thereof as they in their
discretion shall think expedient and proper.

SEC. 6, And be it enacted, That the ground on which the
old road passes shall become the property of the owners of
the lands lying along and contiguous to said road.
