ty, be and they are hereby authorised and directed to levy
upon the assessable property of said county at their next
levy, a sum sufficient to refund to the said vestries the
amount so paid by them; provided, it shall appear to the
said commissioners, that the said tax was levied and col-
lected contrary to law.

Proviso.

CHAPTER 272.

 

A further supplement to the act passed at December session,
eighteen hundred and thirteen, chapter two hundred and
sixteen entitled, An act relating to Sheriff's, and for other
purposes.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the first, second and fourth sections, of
the act passed at December session eighteen hundred and
forty, chapter two hundred and sixteen, be and the same
are hereby repealed.

Repealed.

SEC. 2. And be it enacted, That it shall be the duty of
the executor or administrator of any sheriff, coroner, or
elisor, who has died, or may hereafter die, either before or
after the expiration of his term of service, having in his
hands any writ or process of any description issued by any
court in this state, to return the same to the clerk or regis-
ter of the court out of which the same issued, together
with all schedules, lists, entries and memoranda if any,
shewing the acts and proceedings of such sheriff, coroner,
or elisor, in virtue thereof, and the said clerk or register
on the application of the plaintiff or other party or person for
whose use any such process may have issued, shall issue a
duplicate thereof to the sheriff or other proper officer for
the time being, and if it shall appear that the said writ so
returned, remained wholly unexecuted, the said sheriff or
other officer shall proceed in execution of said dupli-
cate as if said writ had not issued to the deceased she-
riff or other officer, but if it shall appear that said writ was
partly executed, at the time of the death of the sheriff or
other officer having the same, then the sheriff or other offi-
cer so receiving said duplicate shall and may proceed in
execution thereof in the same manner as the deceased she-
riff or other officer in his life time, might or could have
done in execution of said original process, and may make
the same returns that said deceased sheriff or other officer,
