or disposed of, before the second Thursday, and if all of
said criminal cases are not tried or disposed of before the
second Thursday, then the said appeal cases shall be post-
poned until said criminal business is disposed of, and then
such appeals shall be taken up and all tried and disposed of
before any other business in said court.

CHAP. 234.

SEC. 2. And be if further enacted, That all witnesses at-
tending said court in cases on the civil trial docket, shall
bo discharged when the court adjourns on the first Satur-
day of the term, until nine o'clock on the third Monday of
the term, and on the third Monday of the term of all the
criminal and appeal cases shall have previously been dis-
posed of; the trial of cases on the civil docket which have not
been previously disposed of, shall be renewed and disposed
of, but if the whole of the said criminal and appeal cases
shall not have been disposed of before the third Monday
of the term, the trial of cases remaining on the civil docket
shall be postponed until after all the said criminal and ap-
peal cases shall have been disposed of.

SEC. 3 And be it further enacted, That if the trial of the
said criminal and appeal cases shall not occupy the whole
of the second week of the term, the court shall discharge
the jurors until the third Monday of the court, and during
the said interval that shall then occur, hear arguments of
counsel and cases on the equity side of said court, and such
questions of law and fact as may be brought before the
court by consent of parties or their counsel.

SEC. 4. And be it further enacted, That the said court
shall not require parties to proceed in any of the business
of the court in any other manner, or at any other period of
the term, than as hereinbefore prescribed.

SEC. 5. And, be it enacted, That all subpoenas for wit-
nesses on the civil docket, shall be returnable on the first
Monday of the term, and subpoenas for witnesses on the
Criminal docket on the second Monday, and subpoenas on
the appeal docket on the second Thursday of the term.
