LAWS OF MARYLAND.

SEC. 4. And be it enacted, That a majority of said trus-
tees for each of the said school districts as soon as convenient
after their appointment, and annually thereafter shall make
a census of the poor children in the school district of
which they are trustees, of the proper age to go to school,
describing their names and ages, whose parents or friends
are unable to pay for the tuition of such children, and that
said trustees or a majority of them of said districts shall ap-
portion among the schools in their respective districts, such
sums of money to said school as they may think right and
proper, having reference to the number of poor children
therein.

SEC. 5. And be it enacted, That the said school fund
shall be apportioned among the several election districts in
said county by the commissioners, according to their respec-
tive population, assuming as a basis on which to make such
apportionment, the number of votes cast in each election
district, at the November election in the year eighteen hun-
dred and forty.

SEC. 6. And be it enacted, That the trustees of the
respective school districts to whom shall be paid any part
of the money referred to in the third section of this act,
shall give a receipt to said commissioners for the sum or
sums so received by them respectively, and shall account to
the said commissioners therefor annually, in the month of
May, and in case any trustees shall neglect or refuse to ac-
count to the said commissioners at the lime heretofore pro-
vided, such trustees so refusing or neglecting to account as
aforesaid, shall, and he, his heirs, executors and administra-
tors, shall be responsible to the said commissioners for
such sum or sums of money or any part thereof, to be col-
lected as other debts are now collected.

SEC. 7. And be it enacted, That the trustees of the re-
spective school districts shall make return in writing to the
commissioners for Somerset county, in the month of May
annually, stating the number of scholars taught, their names,
and the names of their parents, and the length of time occu-
pied in teaching them, and the amount paid by them for
tuition.

SEC. 8. And be it enacted, That the trustees of the said
school districts, or a majority of said trustees, shall select
and choose the schools in their respective districts to whom
shall be sent the children described in the fourth section
of this act, having due regard to the moral character and
capacity to instruct of the teacher.

SEC. 9. And be it enacted, That all laws of this State
inconsistent with the provisions of this act, be and the same
are hereby repealed, so far as the same relates to Somerset
county.
