CHAP. 199.

CHAPTER 198.

Passed March
6, 1843.

A supplement to an act entitled, An act to give to the Chan-
cellor and the County Courts, as Courts of Equity, ju-
risdiction in cases of divorce.

Divorce, &c.

SEC. 1. Be it enacted by the General Assembly of Ma-
ryland, That when an application is made to any court in
this State having jurisdiction over the subject for a divorce
o vinculo matrimonii, the fact that the parties have been di-
vorced, a mensa et thoro shall not be taken to interfere with
the jurisdiction of the court over the subject, and that any
bill dismissed for such reason shall be reinstated and be
acted upon de novo.

SEC. 2. And be it enacted, That the admission of a re-
spondent of the facts charged in a bill for a divorce, who
consents to the application, shall not be taken of itself as
conclusive proof of the facts charged, as the ground of the
application.

 

CHAPTER 199.

An act for the promotion of Education in Somerset county.

Treasurer to
pay over to
order of com-
missioners.

SECTION 1. Be it enacted by the General Assembly cf
Maryland, That the treasurer of the Western Shore be
and he is hereby authorized and required to pay over to the
order of the commissioners for Somerset county, all sums
of money which are now or may hereafter be apportioned.
to said county, out of the common or free-school fund of
said State, or which may be apportioned to said county out
of the interest of the State's proportion of surplus fund of
the United States, or which said county may be entitled to
receive from the said State for common school purposes
from any fund whatsoever.

SEC. 2. And be it enacted, That the school districts in
said county shall be and remain as they are now laid off in
pursuance of the first section of an act of assembly passed
December session eighteen hundred and thirty-seven,
chapter three hundred and three.

SEC. 3. And be it enacted, That the said commissioners
shall proceed to appoint some time during the month of May
next, for each school district in said county, three trustees,
to one of whom shall be paid by said commissioners all
or any portion of the monies that may be appropriated to
said school district respectively.
