CHAP. 187.

ed by the Levy Court shall appoint three taxable inhabi-
tants of such school district to act as local trustees until
their successors be appointed or elected, but any three tax-
able inhabitants of such district may at any time give pub-
lic notice in writing, to be set up at two or more public
places in this district, when an election shall be made in the
manner prescribed by law, and such election when made
shall be as valid and good in law as if made on the first Sa-
turday in May, and the local trustees when so appointed or
elected shall remain in office until their successors are elect-
ed by the taxable inhabitants, and the local trustees so
elected shall always supercede those appointed by 1he
general trustees, and all vacancies among the local trustees
shall be filled in like manner by an election of the taxable
inhabitants, or if they neglect or refuse, by the general
trustees.

SEC. 5. And be it enacted, That no teacher of any Pri-
mary School shall be entitled to receive his salary unless
in addition to the verification of his account now required
by law, or the regulations of trustees, he shall produce a
certificate of the local trustees, or three or more respecta-
ble taxable inhabitants, where there are no local trustees
that he has faithfully discharged his duty as teacher, and
the trustees shall be the sole judges and have full pow-
er to decide whether the teachers are entitled to receive
their salaries, and what deduction, if any is to be made for
lost time, negligence or inattention, and from their judgment
there shall be no appeal whatever, but they may; re-open
and decide on any case at any time within one year from

SEC. 6. And be it enacted, That the whole amount of
the school fund received annually from the State, and the
interest of the money now under the control of the Or-
phan's Court shall be applied to the payment of the teach-
ers of the Primary Schools, and the trustees of said schools
are hereby authorized to demand the same of the Orphan's
Court, and the said court is hereby authorized and required
to pay over the same to the trustees, or to their order or
orders.

SEC. 7. And be it enacted, That the Orphan's Court
j is authorized and empowered if they think proper to do so,
to invest the whole or any part of the principal of the
school fund under their control in the stock or bonds of the
State, at such time or times, and upon such terms as they
